Atuche, Ojo Granted N450B Loan Without Collateral - EFCC

Former managing director of Bank PHB, Francis Atuche and one of his executive directors, Charles Ojo arraigned at a Federal High Court sitting in Lagos,  have been accused of granting a credit facility of N450billion without any collateral. The Economic and Financial Crimes Commission, EFCC, made this allegation on Tuesday at the resumed hearing of their bail application.

Counsel to the EFCC, Kemi Phinherio, SAN, told the court that the credit facility was given frivolously without collateral and that the two bank chiefs acted beyond their approval limits.

Atuche and Ojo were arraigned on a 26 count charge last Wednesday before Justice Akinjide Ajakaiye. The EFCC accused them of mismanagement of depositors’ funds and abuse of credit management rules. They both pleaded “not guilty” to the charges preferred against them.

In a bail application deposed to by Atuche’s wife,  Elizabeth, his counsel  Tony Idigbe,SAN prayed the court to “consider the application in liberal terms because medical reports showed that Atuche is suffering from systematic hypertension and obstructive airway disease” . Counsel to Ojo, Mike Osekhome, also prayed the court to consider his bail application in favour of his client owing to  the constitutional  presumption of his  innocence.

All these claims cut no dice with the EFCC. Phinherio insisted that, if granted bail, the suspects will interfere with the investigations of the commission and may unduly influence all the witnesses the commission relies upon. Justice Ajakaiye adjourned ruling on the bail application till Novenber 9th , 2009 while they still  remain in the custody of the EFCC.

Albert, these are the corrupt Nigerians we are talking about, the likes of Atuche Who will do things without minding the consequence. There is no mercy, the law should be followed. The advanced economies you are quoting will not handle this issue less than EFCC is handling it. Dont bring sentiments into this, Atuche is corrupt

I believe very strongly that FA and others should be granted bail asap. The idea of influencing the witnesses is quite frivolous. If you have an evidence that you feel kept them in EFCC custody, I do feel they should be granted bail and if necessary, subjected to reporting to the EFCC office everyday. There are plenty of people in Nigeria that have caused more problems and are even in the Senate, making laws for you and I. These men were employers of Labour and if there's any issues, we can borrow a leaf from other better economies and put things right. The ways we are handling things in our nation may not be the best to go about them. Our future generations will ask questions, let us build a solid foundation for this Nation and be upright in all our decisions. Regards,

Most of The Justices and Judges in Nigeria are: ORIGINAL BRIBE-TAKERS! So, the only way Mr. Rule of Law, a.k.a. Baba Go-Slow can ensure Fair-Play(?), thereby "Satisfying" The Masses, is to transfer The case to Justice Oyewole (- our HERO!) I am sure the Minister for (In)Justice, Mr. Michael Anachoda (- or is it Androchadaaaaa) will quickly say: "Out of Jurisdiction", and Mr. Go-Slow will say: "Rule of Law"! Out of Jurisdiction, My Foot!, Rule of Law, My ASS!!!!!
